Abstract
Fundamental changes will shortly be introduced in the way developers and agents prepare and lodge planning applications. The new Scottish Planning Act is now in force and the procedural changes embodied in the “secondary legislation” are due to be introduced in the new year. Almost every aspect of the system is changing in some way, from first contact with the planning authority right through to appeals. The seminar will consider the choices that applicants will have to make, the new procedures that major development proposals will require to follow, and the extra obligations they will be faced with. For example, statutory community consultation is proposed which must take place before a “major” planning application is lodged - and the Government are saying what this must comprise. Unresolved issues will be discussed – there is debate about thresholds between “major” and “local” developments: the category an application falls into could result in thousands of pounds in additional fees and could change the right of appeal. Appeals for “minor” applications will be dealt with by the Council that refused the application, rather than the Directorate of Planning and Environmental Appeals. Councils are to be left to decide what is a “minor” application through a “Scheme of Delegation”. These, and many other issues will be discussed in the seminar.
Speaker: John Paton, Turley Associates
John Paton is a town planner and urban designer who has worked in consultancy for nine years, now as a Director in the Glasgow Office of Turley Associates and previously as Associate Director in McInally Associates. In that time he has advised a range of clients on a wide range of urban, suburban and rural developments throughout Scotland. He has assisted developers in the housebuilding, city centre commercial, hotel, industrial, retail, transport and general development sectors and negotiated planning permissions for some of the largest developments in the West of Scotland. Prior to his consultancy work, John was Senior Planning Officer in Glasgow City Council working in the development control, local plans and transportation sections. Recent major projects include the “Elphinstone Tower” project at Charing Cross, the “Argyle International” Hotel project in Argyle Street, East Dunbartonshire Schools PPP projects, and housing planning permissions for Taylor Wimpey at Bishopbriggs and Kilsyth.
