Abstract

The first part of the Seminar will deal with each of the most commonly used forms of dispute resolution.  Firstly, there will be a consideration of Court actions in both the Court of Session and the Sheriff Court.  Particular attention will be paid to the increasing use of the commercial procedure in both Courts.  Next, the Seminar will look at adjudication, including those parts of the procedure to which particular attention requires to be paid, and there will be a brief round up of recent developments.  There will also be a discussion of mediation and the circumstances in which it can be used to good effect in the construction industry.  Finally, the Seminar will deal with  arbitration, which is the traditional method of dispute resolution in the construction industry.  Guidance will be given as to which type of dispute resolution is appropriate in which circumstances.

The second part of the Seminar will turn to look at the management of disputes in the construction industry.  In particular, there will be a discussion of the increasing use of dispute escalation clauses in construction contracts.  The seminar will look at the content of such clauses and how they work in practice. 

The complexities of construction contracts and the commercial interests of the parties to them are such that disputes are never very far away.  The Seminar aims to provide guidance to the attendees on the different methods of dispute resolution available in the construction industry; which methods should be used in which set of circumstances; and how some thought ought to be given to the management of disputes at the time contracts are entered into.

John Miezitis, DLA Piper Scotland LLP
John is a member of DLA Piper's Engineering and Construction law team in Scotland. Focussing on contentious building and civil engineering disputes, he has gained an expertise in litigation through acting in high value, complex actions in the Court of Session;  and through having regularly appeared for clients from various industry sectors, including construction and engineering, insurance, and oil and gas, in the Sheriff Court for several years.  He also deals with other methods of dispute resolution, in particular, adjudication, mediation and arbitration. 

Clients of DLA Piper's Scottish Engineering and Construction team include developers (both within the public sector and private sector), main contractors, sub-contractors, consultants, funders, tenants and purchasers, each with separate interests within the industry.

  • To cover the costs of the venue hire and catering, CBE will send an invoice for £35 per delegate on receipt of a booking. (Members of the IVM will be free of charge, please mention when booking)
  • In event of cancellation by CBE, a full refund will be made available.
  • In event of delegate cancellation, an administrative fee of £15 will be charged for up to a week before the event - there will be no refund after this point.
  • It is now possible for your organisation to make a block booking for events. 10 bookings will cost just £250.  These can be redeemed in any combination against any seminar. There will be no refunds for organisations taking up the block booking of 10 delegate places at a cost of £250 (a saving of £100).

Delegates are welcome to the CBE seminars even if they have not booked places. However, please advise CBE by telephone or by e-mail no later than 10am on the morning of the seminar, as we must have definite numbers for our presentation packs, catering and seating allocation.
