The Management and Resolution of Disputes in the Construction Industry Date: Tuesday, 15th January 2008 Programme Abstract The first part of the Seminar will deal with each of the most commonly used forms of dispute resolution. Firstly, there will be a consideration of Court actions in both the Court of Session and the Sheriff Court. Particular attention will be paid to the increasing use of the commercial procedure in both Courts. Next, the Seminar will look at adjudication, including those parts of the procedure to which particular attention requires to be paid, and there will be a brief round up of recent developments. There will also be a discussion of mediation and the circumstances in which it can be used to good effect in the construction industry. Finally, the Seminar will deal with arbitration, which is the traditional method of dispute resolution in the construction industry. Guidance will be given as to which type of dispute resolution is appropriate in which circumstances. The second part of the Seminar will turn to look at the management of disputes in the construction industry. In particular, there will be a discussion of the increasing use of dispute escalation clauses in construction contracts. The seminar will look at the content of such clauses and how they work in practice. The complexities of construction contracts and the commercial interests of the parties to them are such that disputes are never very far away. The Seminar aims to provide guidance to the attendees on the different methods of dispute resolution available in the construction industry; which methods should be used in which set of circumstances; and how some thought ought to be given to the management of disputes at the time contracts are entered into.
