Abstract

In difficult economic times, those involved in the Construction Industry are more likely to become involved in disputes. The seminar focuses on dispute resolution and, in particular, takes a look at some recent important case reports. In particular, the seminar will consider the second House of Lords' decision to consider the Housing Grants, Construction and Regeneration Act 1996. In addition, the seminar will look at several recent cases including those involving adjudication, which have a bearing on such matters as the significance of correctly identifying the name of the Referring Party in the Referral Notice; a decision which affects the rule governing when a party may introduce new arguments at adjudication; and enforcement of an adjudicator's decision in circumstances where there has been an alleged breach of the rules of natural justice.  The seminar will give useful practical guidance on the effects of the decisions in these cases, and tips on how to deal with the relevant issues when they arise in practice.

Speakers: John Miezitis & Chris Martin, DLA Piper

John Miezitis is a member of DLA Piper's Engineering and Construction law team in Scotland.  Focussing on contentious building and civil engineering disputes, he has gained an expertise in litigation through acting in high value, complex actions in the Court of Session; and through having regularly appeared for clients from various industry sectors, including construction and engineering, insurance, and oil and gas, in the Sheriff Court for several years.  He also deals with other methods of dispute resolution, in particular, adjudication, mediation and arbitration.

Andrew Jack is also a member of DLA Piper's Engineering and Construction law team in Scotland, and he advises clients on a wide range of both contentious and non-contentious construction and engineering matters.
He has advised clients in major disputes involving various forms of dispute resolution, including litigation, adjudication and mediation.  He also regularly drafts and advises on complex contractual documentation encompassing a wide range of industry standard form and bespoke contracts.
Clients of DLA Piper's Scottish Engineering and Construction team include developers (both within the public sector and private sector), main contractors, specialist sub-contractors, consultants, funders, tenants and purchasers, each with separate interests within the industry.
